Massachusetts Commercial Lease Agreement Template
This Commercial Lease Agreement (hereinafter referred to as the "Agreement") is entered into on this ____ day of __________, 20__, by and between ______________________ (hereinafter referred to as the "Landlord"), with a mailing address of _______________________________________, and ______________________ (hereinafter referred to as the "Tenant"), with a mailing address of _______________________________________. This Agreement is subject to the laws specific to the State of Massachusetts, including but not limited to the Massachusetts General Laws Chapter 186 Leases of Real Property.
Premises
The Landlord agrees to lease to the Tenant, and the Tenant agrees to lease from the Landlord, the premises located at __________________________________ (hereinafter referred to as the "Premises"), for commercial purposes under the terms and conditions set forth in this Agreement.
Term
The lease term shall commence on __________, 20__ and shall terminate on __________, 20__, unless earlier terminated in accordance with the provisions of this Agreement.
Rent
The Tenant agrees to pay to the Landlord a monthly rent of $__________, payable on the first day of each month. The first month's rent shall be due upon the execution of this Agreement. The Tenant may be subject to late fees for any payment that is more than ___ days late, in accordance with Massachusetts law.
Security Deposit
The Tenant is required to pay a security deposit of $__________ upon the execution of this Agreement, to be held by the Landlord as security for the performance of the Tenant’s obligations under this Agreement. The security deposit shall be returned to the Tenant, without interest, subject to the provisions of Massachusetts law, within ___ days after the termination of this Agreement, provided that the Tenant has fulfilled all obligations under this Agreement.
Use of Premises
The Premises shall be used exclusively for commercial purposes and in a manner that complies with all applicable laws, ordinances, and regulations of the State of Massachusetts and any other applicable governmental authorities.
Maintenance and Repairs
The Tenant shall be responsible for all routine maintenance and repairs of the Premises. Major repairs and maintenance of the structural aspects of the Premises, however, shall be the responsibility of the Landlord, unless the need for such repairs arises out of the Tenant's misuse or neglect of the Premises.
Alterations
No alterations, additions, or improvements shall be made by the Tenant without the prior written consent of the Landlord. Any alterations, additions, or improvements made with the Landlord's consent shall become the property of the Landlord upon the termination of this Agreement.
Insurance
The Tenant shall maintain, at the Tenant's expense, a comprehensive policy of public liability insurance for the Premises, with the Landlord named as an additional insured. Proof of such insurance shall be provided to the Landlord upon the commencement of this Agreement and upon renewal of such insurance.
Signatures
This Agreement shall be considered legally binding upon the Landlord and the Tenant, and their respective heirs, executors, administrators, successors, and assigns, upon the execution of this Agreement.
